VISA PROCEDURE

Most students holding a non-British or non-EU passport planning to go and study in the UK require a prior entry clearance visa from their nearest British High Commission.

The student must be able to show that he has been accepted on a course of study at:

  • A publicly funded institution of further or higher education (e.g. a university)
  • A private-education institution
  • An independent fee paying school.

The student is going to pursue:

  • A recognized full-time degree course
  • A weekday full-time course involving at least 15 hours organized daytime study per week
  • A full-time course of study at an independent fee paying school.

The student who is planning to study abroad must also:

Be able to pay for his course and support an accommodation overseas for himself and any dependants without working or without help from public funds

VISA GUIDANCE

In order to secure a non-immigrant student visa, you have to establish the following facts.

  • Good Academic Record
  • Roots to India
  • Good Financial Standing
  • Compatibility of the University Chosen
  • Always use Parents as sponsors to study overseas as if you are using other rather than parents as sponsors give good reasons why they are sponsoring you.
  • Avoid bringing your relatives in the U.K. into the picture either as sponsor or the people who have motivated you to go to the United Kingdom for education.
  • Please do not talk about job and job opportunities around the City that you have chosen for your studies.
  • Your reasons for coming beck to India after completing you studies as far as possible should not be sentimental or emotional reasons.
  • They should be related to good career opportunities substantial financial gains and better business opportunities after obtaining a U.K. qualification.

VISA APPLICATION PROCESS

However, generally students may not require an interview (subject to changes in visa regulations for different countries) if they have:

  • Traveled to the UK in the last ten years and have evidence of this travel
  • Traveled to the US, Australia, New Zealand. Canada, Switzerland or Schengen countries within the last five years and have evidence of this travel
  • Prepaid 100% of their tuition fees and have a receipt to prove it.

If no interview is required, your passport would be returned to the application centre, or couriered to you, within two working days or you may be asked to come and collect it. If however, you are called for an interview, you are likely to get an appointment on the next working day. This might slip during exceptionally busy periods.

The student is likely to be called for an interview if he has:

  • Been refused a visa for the UK or for any other country, unless he has subsequently obtained a visa for that country
  • Been refused entry to the UK or any other country
  • Failed to comply with the conditions of entry to the UK, or sought an extension of stay there.

Study Visa UK


Studying in the UK is a consistently popular option for non-EEA nationals and the UK provides a number of student visas which permit temporary UK immigration to undertake a course of study. While a UK visit visa permits its holder to study in the UK, this is limited by the visa’s maximum duration of six months. UK study visas allow students to relocate to the UK in order to gain a recognized qualification.

Student Visa Benefits


Although a student visa is not in itself a route to permanent residency in the UK, applicants may be able to switch into another UK immigration service, such as the Highly Skilled Migrant Programme (HSMP) or a UK work permit, which may lead to the opportunity to apply for Indefinite Leave to Remain in the UK, and ultimately to apply for UK Citizenship. A UK student visa does not constitute the right to live and work in the UK, however in some circumstances, students may be able to supplement their finances by undertaking limited work. Students may work for up to 20 hours per week and may be able to work longer hours in vacation periods.
In the UK visas for students are generally granted for an initial period of one year, however there is no set duration and the permit can be renewed as required in order to complete the course of study.

Study Visa Eligibility


Like a UK work permit, the key requirement for study visas is that a genuine offer from a UK visa sponsor must be in place. In the same way that UK work permits require an offer of employment from a UK employer, applicants who wish to apply for a UK study permit must have an offer of a place on a course of study at a recognised UK educational institution.
The candidate must be pursing a full time course and must be able to finance him or herself and any dependents throughout their time in the UK without public funding. Although an applicant may bring his or her spouse to the UK, in the student visas category it is not permissible to be accompanied by a common-law or conjugal partner. A spouse will be granted the same period of leave to remain in the UK as the main applicant and will only be permitted to work in the UK if the main applicant’s grant exceeds 12 months.

Student Internship Visa


The Student internship visa allows overseas students to perform a short period of paid employment in the UK, based, like a work permit application on an offer from a sponsoring UK company. Applicants must be already studying a degree course overseas and applications must be submitted by the sponsoring firm. Although a student internship visa is offered for a comparatively brief duration of three months, candidates may be able to switch to a UK work permit if they are offered a full time position.

Applying for a UK Student Internship Visa


Like a UK work permit application, internship visas are not valid for work in any other position than that specified or for any other employer than the sponsoring UK company. However, supplementary work outside normal working hours is permitted so long as it does not exceed 20 hours per week and is not outside the profession for which the permit was issued.

Students may only ever take one internship each and evidence of their student status will be required. The position being offered must be either at or above NVQ level 3 and the remuneration must be equal to that which would be paid to a full time UK permanent resident employee.
Unlike a UK student visa, dependent immigration is permitted not just for a married partner, but for a common-law or conjugal partner. However dependents will not be permitted to work in the UK and must be either able to support themselves or be supported by the main applicant.

A student visa must be obtained before an applicant can begin a course and applications depend upon the individual securing a confirmed place on a course from a bona fide Australian educational institution. Students who successfully obtain a place on a full time course at a recognised institution will receive an electronic confirmation of enrolment (eCoE). It may be necessary to show evidence of this as part of an application.

Australian Student visas are normally issued as multiple entry permits allowing holders to travel to and from Australia as many times as they choose, within the validity of the visa. The validity is normally based upon the duration of the course. Study visas also make provision for spouse immigration and a candidate’s spouse and unmarried dependent children aged under 18 years may accompany the main applicant to Australia for the same length of time.

Types of Australian Student Visa

Subclass 570 - Independent ELICOS Visa

Subclass 573 - Higher Education Visa

The higher education visa applies to those studying for a Bachelor degree, Graduate Certificate, Graduate Diploma or Associate Degree.

Subclass 574 - Postgraduate Research

Postgraduate research visas apply to Masters degrees and PhDs

Subclass 575 - Non-award

This visa class specifically covers bridging or foundation courses which do not involve an award of any kind.

Requirements

Study visa applicant must be in good health and of good character and must not have any debts. Applicants must ensure that they fulfil the requirements of their course, including attendance and must only work in Australia where express permission is granted.
Australian student permits oblige the holder to remain with the sponsoring institution for a minimum of 12 months, or the entire course in circumstances where the course duration is less than 12 months. Applicants must also advise the educational institution of their address within seven days of arrival. Students must be able to support themselves and any dependents financially during their time in Australia and must have a sufficient level of proficiency in the English language to successfully complete their course.

Assessment

In Australia, candidates are assessed at one of 5 levels depending upon the country whose passport they hold. Levels are based upon previous conduct of students from these countries and the perceived likelihood of the student undertaking and completing the proposed studies. The process seeks to determine that a student is genuinely entering the country in order to study. The higher the number of the assessment level, the more evidence it will be necessary to submit in order to secure a successful application. Student Visa Canada

  • Candidates must possess an acceptance letter from a recognised educational institution in Canada confirming a definite offer of a place on a course of study.
  • Candidates must be able to show that they can support themselves financially throughout their time in Canada, and that they can afford to live near to the location of the institution.
  • Since Canadian study permits are issued as temporary visas, it will be necessary for applicants to show their intention to return to their country of residence upon completion of studies.
  • In some cases, applicants may have to undergo a medical examination.

Applying for a Temporary Resident Visa


Nationals of some countries who wish to temporarily immigrate to Canada in order to study will need to apply for a temporary resident visa or TRV. If you require a temporary resident visa for Canada this must be obtained at the same time as the application for a study visa. Canadian Study Visa Exemptions


Although the vast majority of people studying in Canada need to be in possession of a visa, in some cases it is possible to study in Canada without one. New Zealand Student Visas


The New Zealand Government encourages international students to study in New Zealand. Those students who complete a NZ qualification which meets residence criteria, may apply for a work permit and/or residence on completion of their studies.
